Employment Agreement
This Employment Agreement ("Agreement") is entered into by and between **** ("Employer") located in ****, Suwon, Kyounggi, Korea, established and operating under the laws of Korea and (“Employee”) with residence at ****
Article 1: Employment
Employer hereby agrees to employ Employee, and Employee hereby accepts employment as Employer's Engineer upon the terms and conditions set forth herein. Employee warrants that he has no legal problems with respect to Employee's previous employment.
Article 2: Description of Employee’s Duties
Subject to the supervision and pursuant to the orders, advice, and direction of Employer, Employee shall perform such duties as are customarily performed by one holding such position in other businesses or, other enterprises of the same or similar nature as that engaged in by Employer. Employee shall additionally render such other and unrelated services and duties as may be assigned by Employer.
Article 3: Term
This Agreement shall, unless earlier termination in accordance with other
provisions hereof, remain in effect for a term of one (1) year ("Term") beginning
on **** ("Effective Date") and ending on ****
The Term may be extended by written agreement between Employer and Employee.
Article 4: Working Conditions
Employee's work site will be Employer's *** Division *** Suwon, Korea, and if necessary, may be changed upon Employer's request.
Employee will be treated on the basis of this Agreement, different from the other regular employees of Employer, and shall not request any other compensation to Employer, except the compensation explicitly mentioned in this Agreement.
Employer shall pay Employee and Employee agrees to accept from Employer, in full payment of Employee’s service in this Agreement, compensation at the rate of **** (US) **** Dollars(US$) (Net) per month on the Every 21st day of each month.
4. Housing
Employer shall provide Employee with a furnished apartment and thirty (30) meals per
month in Employer's Cafeteria according to Employer’s internal regulations.
5. Insurance
Medical Insurance. Employer shall pay fifty (50%) percent of Employee's medical insurance under the same conditions as applied to other regular employees.
2) Medical Care Expenses
Employee's medical expenses can be reimbursed by Employer according to the company's regulations. Medical expenses for other family members will not be reimbursed by Employer.
3) Industrial Disaster Insurance
Employer shall be responsible for the Industrial Disaster Insurance for Employee by regulation or law.
6. Working Hours
Working Hours
Employee shall work eight (8) hours a day, for a total of forty (40) hours a week. Employee understands and agrees that Employer can demand work overtime.
7. Vacation
Employee shall have fifteen (15) vacation days per year for the Term of this Agreement,
excluding Sundays and legal holidays. The vacation days, which are not used in one year, shall not be paid back to Employee in money or carried over to the next year.
In addition to above mentioned standard vacation Employee shall have non -paid 10 days vacation to defense his PhD thesis; Employer shall pay for airplane tickets for this trip.
8. Business Trip
For Employee's business trips for Employer, Employer shall provide Employee with
a per diem expense, lodging, transportation fees according to the company's
regulations.
9. Retirement Allowance
Employer shall pay Employee retirement allowance according to the Employer's internal regulations.
10. Miscellaneous
During the Term of this Agreement, Employer shall not compensate Employee for any salary losses caused by fluctuation of the currency exchange rate.

Article 5: Duty Regulations
Employee shall observe Employer's Duty Regulations, in Korea and in foreign countries.
Article 6: Confidentiality
Employee shall work only for the sake of Employer and shall not work for, or collaborate with, any other party besides Employer during the Term of this Agreement.
2. Without Employer's prior written consent, Employee shall not, without limitation,
reveal, disclose, or hand over the technical documents and confidential information
among other things, which are obtained while working for Employer during and
after the Term of this Agreement. Confidential information means any and all
Employer's proprietary information, including but not limited to, information about
employees, products, and other management information related to Employer.
3. Employee shall return immediately all technical documents to the Employer at the expiration or termination of this Agreement.

4. Employee shall carry Employee's foreigner identification card at all times when commuting to and from Employer's workplace.
Article 7: Employer's Right to Intellectual Property Developed by Employee
Employee acknowledges that all intellectual property and/or inventions created by
Employee during the term of his employment shall belong to Employer. In such an event, Employee shall assign all intellectual property and/ or inventions to Employer.
Article 8: Employee’s Loyalty to Employer’s Interest
1.During the Term of this Agreement, without prior written consent of Employer, Employer shall not make any representation, guarantee, or statement, orally or in writing, which would contravene any policy of the Employer and Employer shall not have the right to make any contracts or other commitments for or on behalf of Employer without written consent of Employer.
2.Employee shall devote all of his time, attention, knowledge and skill solely and exclusively to the business and interests of Employer, and Employer shall be entitled all benefit , emolument, profits, or other issues arising from or incident any and work, services and advice of Employee.. Employee expressly agrees that during the Term and within one (1) years after any termination of this Agreement. he will not be interested, directly or indirectly, in any form, fashion or manner as partner, officer, director, adviser, employee, or any other form or capacity, in any other business similar to employer’s business.
Article 9: Termination
Termination With Cause. Employer shall have the right to terminate this Agreement immediately if Employee cannot perform his duties or if Employee's performance falls in the case described as below.
1. Employee's failure to follow Employer's orders and/or violation of Employer's service regulations.
2. Employee's intentional act causing Employer damages and/or Employee's explicit
illegal activities against Employer.
3. Employee's commission of an immoral or undignified act.
4. Employee's commission of illegal activities in Korea, as well as abroad.
5. Employee's disclosure of Employee's Annual Salary to third parties, including but not limited to, Employer's other employees.
6. Employee's falsification of Employee's educational background and career experience.
7. Employee’s absence from work for more than three (3) days without prior written notice.
8.Disability of Employee. As used in this Agreement the term “disability” shall mean his inability, due to physical or mental disability, for a period of fifteen (15) days, whether consecutive or not, during the Term of this Agreement.
9. Any violation of the this Agreement.
Termination Without Cause. Employer shall have the right to terminate this Agreement without cause by notifying Employee in writing sixty(60)days in advance.
Article 10: General Terms
1. All other terms and conditions not stipulated in this Agreement shall be decided by Employer’s internal regulations.
2. Any changes to this Agreement shall be valid only by affixing an addendum concerning articles to be revised or added, signed by duly authorized representatives of Employer and Employee.
3. Employee may not assign or transfer his rights and obligations under this Agreement to a third party.
4. This Agreement shall be governed by the laws of the Republic of Korea.
5. Any dispute or claim concerning the scope, meaning construction or effect of this Agreement or arising from any aspect of this Agreement shall be settled exclusively at the Suwon District Court, Korea.
6. This Agreement shall be executed in both an English and a Korean version. In the event of a dispute regarding this Agreement, the Korean version shall be legally binding and the controlling version. The English version shall be for reference purposes only.
This Agreement shall be executed in two (2) identical counterparts, each of which shall be deemed to be an original and all of which taken together shall be deemed to constitute this Agreement when a duly authorized representation of each Party has signed each counterpart.

Шафир, никто ничего не скрывает. Люди, которые контракт читали и подписывали - вам говорят, что всё нормально и опровергают ваши "разоблачения". Пересмотрел свои контракты - везде есть этот пункт, может и в вашей версии был, только владелец его выкусил от греха подальше? ;)

Правильный момент - было написание приклеенной темы, объясняющей новичкам ситуацию со старожилами форума. Вопрос препираний с Шафиром, думаю, этим исчерпан.
